These Terms & Conditions apply to consumer vehicle purchases from Autobahn Direct.
Nothing in these terms excludes, restricts or reduces any statutory rights or remedies available to a consumer under applicable UK law, including the Consumer Rights Act 2015.
1. Used Vehicle Condition
All vehicles supplied by Autobahn Direct are used vehicles unless expressly stated otherwise.
A used vehicle will have been previously driven and may display reasonable signs of age, mileage and previous use.
The condition reasonably expected of a used vehicle depends on relevant circumstances including its age, mileage, price, description and condition.
This does not affect the customer's statutory rights concerning satisfactory quality, fitness for purpose where applicable, and the vehicle being as described.
2. Vehicle Descriptions
Autobahn Direct takes reasonable care to ensure vehicle advertisements, descriptions, specifications, mileage and photographs are accurate.
Customers should notify us before purchase if a particular specification, feature or intended use is especially important to their purchasing decision.
Nothing in this section permits Autobahn Direct to misdescribe a vehicle or withhold material information which we are legally required to provide.
3. Inspection and Test Drive Before Purchase
Customers are encouraged to inspect and, where appropriate, test drive a vehicle before completing their purchase.
Any specific defect expressly disclosed to the customer before purchase may be taken into account when assessing the condition which the customer was entitled reasonably to expect.
A customer's pre-purchase inspection does not remove or reduce statutory consumer rights.
4. Deposits & Vehicle Reservations
When Autobahn Direct accepts a deposit to reserve a particular vehicle, the vehicle may be removed from sale or marked as reserved and other prospective purchasers may be turned away.
By paying a deposit, the customer confirms a genuine intention to purchase the vehicle and accepts the reservation terms explained at the time of payment.
If the customer subsequently changes their mind, fails to complete the purchase within the agreed period, or withdraws from the transaction for reasons not attributable to Autobahn Direct, Autobahn Direct may retain the deposit to the extent permitted by law and reasonably necessary to reflect loss resulting from the cancellation.
A deposit will not be retained where doing so would unlawfully restrict a customer's statutory rights, including where Autobahn Direct is in breach of contract or the customer otherwise has a legal entitlement to repayment.
Any statutory cancellation rights applying to a distance or off-premises contract remain unaffected.
5. Payment
Unless otherwise agreed in writing, the purchase price must be received in cleared funds before the vehicle is released.
Autobahn Direct may undertake reasonable identity and payment verification checks before releasing a vehicle.
6. Finance
Any finance application is subject to eligibility, status, lender approval and the terms of the relevant finance provider.
Submitting an application does not guarantee finance approval.
7. Part Exchange
Part-exchange valuations are based on the information supplied by the customer and the condition of the vehicle.
Customers must provide accurate information regarding ownership, mileage, condition, damage and known material faults.
Autobahn Direct may revise a valuation if the vehicle materially differs from the description supplied.
8. Customer Responsibilities & Acceptable Vehicle Use
Following purchase, customers are responsible for using and maintaining their vehicle appropriately.
- Maintain appropriate engine oil and coolant levels.
- Maintain other required vehicle fluids.
- Maintain suitable tyre pressures.
- Use the correct fuel, oils and fluids.
- Follow applicable servicing requirements.
- Respond appropriately to dashboard warning lights.
- Do not continue driving where doing so may be unsafe.
- Do not continue driving where doing so may cause additional damage.
- Do not overload or misuse the vehicle.
- Keep the vehicle roadworthy and legally compliant.
Misuse, neglect, accident damage, unsuitable modifications or continued driving after a serious warning may affect whether a later problem was caused by the condition of the vehicle when supplied.
This does not remove statutory rights where Autobahn Direct is legally responsible for a fault.
9. Wear & Tear and Maintenance Items
Used vehicles contain components that naturally deteriorate through age, mileage and normal use.
Depending upon the circumstances, examples may include:
- Tyres
- Brake pads
- Brake discs
- Clutch friction components
- Wiper blades
- Bulbs
- Routine service and maintenance items
However, Autobahn Direct will not automatically reject a complaint merely because the component is normally subject to wear.
Each complaint will be assessed according to its individual circumstances, including vehicle age, mileage, price, condition at sale, mileage travelled since purchase, maintenance history and the nature and cause of the failure.
Where premature failure means that the vehicle did not meet the standard required by law when supplied, the customer's statutory rights remain unaffected.
10. Reporting a Fault
Customers should provide reasonable information regarding the problem, including symptoms, warning messages and when the problem occurred.
If continuing to drive could be unsafe or cause additional damage, STOP DRIVING THE VEHICLE.
Contact Autobahn Direct on 07301 367630.
11. Autobahn Direct's Right to Inspect
Where a customer reports a fault and seeks a remedy from Autobahn Direct, we must be given a reasonable opportunity to inspect and diagnose the vehicle and determine the nature and cause of the reported problem.
Except where emergency action is reasonably necessary for safety or to prevent further damage, customers should give Autobahn Direct a reasonable opportunity to inspect the vehicle before authorising substantial repairs elsewhere at our expense.
This does not prevent a customer obtaining an independent inspection or exercising any statutory right.
12. Returning the Vehicle to Autobahn Direct
Where a vehicle needs to be inspected, diagnosed or repaired by Autobahn Direct, the customer will normally be required to make the vehicle available at:
Autobahn Direct
2A Bridgewater Road
Wembley, Middlesex
HA0 1AJ
Where the vehicle can safely and lawfully be driven, the customer will normally be responsible for bringing the vehicle to our premises.
Where the vehicle cannot safely be driven, the customer should contact Autobahn Direct and arrange appropriate vehicle recovery rather than continuing to drive it.
Nothing in this procedure overrides any legal obligation Autobahn Direct may have in the particular circumstances, including any obligation concerning the reasonable costs of providing a statutory remedy.
13. Roadside Assistance & Recovery
Customers should ideally maintain breakdown membership that provides vehicle recovery to a garage if the vehicle becomes immobilised.
Unless expressly included in the customer's purchase agreement, Autobahn Direct does not provide roadside assistance or roadside recovery as part of the vehicle purchase.
If the vehicle cannot safely be driven, customers should contact their breakdown/recovery provider and Autobahn Direct.
14. Third-Party Repairs
If a customer believes Autobahn Direct is responsible for a vehicle fault, they should contact us before instructing another garage to carry out repairs at our expense.
Except where emergency work is reasonably necessary, customers should obtain our agreement before authorising substantial third-party repair costs which they expect Autobahn Direct to reimburse.
Autobahn Direct will not automatically accept liability for costs incurred without first being given a reasonable opportunity to investigate the reported fault.
Nothing in this section restricts any statutory right to reimbursement which a customer may have under applicable law.
15. Damage, Misuse & Customer-Caused Faults
Autobahn Direct will not ordinarily be responsible for a problem caused after sale solely by:
- Accident or collision damage.
- Negligent or improper use.
- Incorrect fuel or fluids.
- Failure to maintain appropriate oil or coolant levels.
- Unsuitable or unauthorised modifications.
- Racing, motorsport or abnormal use.
- Overloading.
- Failure to undertake required maintenance.
- Incorrect third-party repairs.
- Continuing to drive after a serious warning where this causes additional damage.
These provisions apply only to the extent that the customer's act or omission actually caused or materially contributed to the reported problem.
They do not permit Autobahn Direct to avoid responsibility for a fault for which it is legally responsible.
16. Warranty First Repair Plans
Where a Warranty First repair plan is supplied or purchased with a vehicle, the repair plan is additional to the customer's statutory consumer rights.
Warranty First repair plans are administered by Warranty First and are subject to the applicable plan eligibility requirements, limits, exclusions, servicing requirements and terms.
Customers should read the Warranty First Repair Plan Booklet and their individual plan schedule.
Warranty / Repair Plan Exclusions
Not every mechanical or electrical failure is necessarily included under a Warranty First repair plan.
Maintenance requirements, excluded components, wear-related matters, repair limits and other exclusions are governed by the Warranty First booklet and the customer's individual plan.
An exclusion under a separate repair plan does not automatically mean that Autobahn Direct has no responsibility under consumer law. Any statutory responsibility will be assessed separately.
17. Your Statutory Consumer Rights
Nothing in these Terms & Conditions limits rights available under the Consumer Rights Act 2015 or other applicable consumer legislation.
Vehicles supplied to consumers must meet applicable legal requirements, including being:
- Of satisfactory quality
- Fit for purpose where applicable
- As described
The standard reasonably expected of a used vehicle takes account of relevant circumstances including its age, mileage, price, description and condition.
18. First 30 Days
Where the requirements of the Consumer Rights Act 2015 are satisfied, a consumer may have a short-term right to reject goods that do not conform to the contract.
Whether that right applies depends upon the circumstances and applicable law. Nothing in these terms removes or restricts that right.
19. Faults Within the First Six Months
Consumer law contains important rules regarding faults discovered during the first six months following delivery.
Autobahn Direct will assess any complaint in accordance with the Consumer Rights Act 2015 and other applicable law.
These Terms & Conditions do not attempt to reverse or remove any statutory burden of proof applicable to Autobahn Direct.
20. Faults After Six Months
The expiry of six months does not automatically end a customer's statutory rights.
However, different evidential requirements may apply and the customer may be required to demonstrate that the problem results from a fault present when the vehicle was supplied rather than subsequent wear, damage, misuse or another cause.
21. Repair or Replacement
Where a customer is legally entitled to repair or replacement, Autobahn Direct will deal with the matter in accordance with applicable consumer law.
Autobahn Direct must be given a reasonable opportunity to inspect the vehicle and, where appropriate, undertake or arrange an applicable repair.
22. Vehicle Modifications
Autobahn Direct is not responsible for faults caused by modifications carried out after purchase by the customer or a third party.
A modification unrelated to the reported fault does not automatically remove statutory rights relating to another defect.
23. Servicing & Maintenance
Customers are responsible for maintaining and servicing their vehicle appropriately following purchase.
Where a separate repair plan requires servicing at specified intervals, customers should comply with those requirements and retain appropriate service invoices and records.
Failure to maintain a vehicle may affect a repair-plan request where permitted under that plan's terms.
It does not automatically extinguish statutory rights relating to an unconnected fault for which Autobahn Direct remains legally responsible.
24. MOT
An MOT certificate confirms that a vehicle met the applicable MOT requirements at the time of the test.
An MOT certificate is not a guarantee that the vehicle will remain free from mechanical faults for the duration of the certificate.
Following purchase, customers remain responsible for keeping the vehicle roadworthy and legally compliant.
25. Vehicle Collection & Delivery
Unless Autobahn Direct expressly agrees otherwise, customers purchasing at our premises are responsible for collecting their vehicle from Autobahn Direct.
Any separately agreed delivery arrangements will be confirmed with the customer.
Different statutory cancellation rights may apply where a contract is concluded entirely at a distance or away from business premises. Nothing in these terms excludes such rights where they legally apply.
26. Change of Mind
For a vehicle purchased in person at our premises, there is generally no automatic statutory right to return the vehicle simply because the customer changes their mind.
This does not affect rights where the vehicle is faulty, misdescribed or otherwise fails to conform to the contract.
27. Complaints
Customers should contact Autobahn Direct promptly if they have a concern regarding their vehicle.
Please provide your name, vehicle registration, purchase date and details of the reported problem.
Where appropriate, Autobahn Direct may ask to inspect the vehicle or obtain further diagnostic information before reaching a decision.

28. Personal Information
Personal information supplied to Autobahn Direct will be handled in accordance with applicable data protection law and our Privacy Policy.
Information may be shared where necessary with relevant finance providers, repair-plan administrators, service providers or other organisations required to complete a requested service or comply with legal obligations.
29. General
If any provision of these Terms & Conditions is found to be invalid or unenforceable, this will not necessarily affect the remaining provisions.
Nothing in these terms is intended to exclude liability or responsibility where doing so is prohibited by law.
Where a provision conflicts with a mandatory statutory consumer right, the statutory right will apply.

3-Month Back-to-Base Warranty
Unless otherwise stated at the point of sale, vehicles supplied by Autobahn Direct include a 3-month back-to-base warranty.
The warranty is intended to provide cover for qualifying mechanical and electrical faults that develop during the warranty period, subject to the terms, conditions and exclusions below.
Back-to-base means that the vehicle must be returned to Autobahn Direct for inspection and, where applicable, repair. Customers must contact us before arranging or authorising any repair elsewhere. Repairs carried out by another garage without our prior written authorisation will not normally be reimbursed under this warranty.

Seals, Gaskets & Minor Leaks
Weather seals and routine sealing items are excluded. Minor oil misting, staining, sweating or seepage which is consistent with the age and mileage of a used vehicle is not covered merely because it is present.
A seal or gasket forming part of a qualifying mechanical repair may be considered where its replacement is reasonably necessary to complete an otherwise covered repair.
Reporting a Fault
Customers should contact Autobahn Direct as soon as a fault becomes apparent. The vehicle should not continue to be driven where doing so could cause additional damage or create a safety risk.
No third-party repair should be authorised on the assumption that Autobahn Direct will pay for it. We must first be given a reasonable opportunity to inspect the vehicle and determine the appropriate course of action.
Important – Your Statutory Rights
This warranty is provided in addition to your statutory rights. Nothing in these warranty terms excludes, restricts or reduces any rights or remedies that you may have under the Consumer Rights Act 2015 or other applicable consumer law.
An item being excluded from this warranty does not, by itself, determine whether a customer may have separate statutory rights in relation to the vehicle.
